FAQs concerning complaints about a physician

• 1- I’m dissatisfied and believe the physician failed to provide professional care. What should I do?

  You may:

  • Talk to the physician or contact the authorities responsible for the health care facility.
  • File a complaint directly with the CMQ. Their mission is to protect the public by ensuring quality medical care.

  2- How do I make a complaint?

  Complaints must be made in writing and sent by email or regular mail. Clearly indicate your contact information.

  2 options are available:

  1. Fill out the form
  2. Write and sign a detailed letter about the situation and then send it my mail or email.

  Have the following information handy:

  • The name(s) of the physician(s) concerned.
  • An accurate description of the facts and the date and location where the events occurred.
  • Your contact information (name, address, email and phone number) and your RAMQ number.

  3- Can I contact a CMQ staff member?

  Yes, if you need information, you want to report misconduct or learn more about the inquiry process, you may reach the CMQ by email at deonto@cmq.org or by phone at 514-933-4441. The service is free and confidential.

  4- I sent my complaint. What happens next?

  The following are the steps in an inquiry once the complaint is received. 

  1. Complaint analysis.
  2. If there are grounds for inquiry, the syndic requests more detailed information, such as clinical records or any other relevant documents. They may also contact certain people for relevant information.
  3. Inquiry conclusion.

  5- What are the possible results of an inquiry?

  1. If the complaint is dismissed the file is closed without further action.
  2. If the complaint is upheld:
     1. Intervention in the form of feedback, such as comments or recommendations.
     2. Workshops, training courses and tutoring to improve skills.
     3. Practical guidance (restrictions, special supervision).
     4. Reporting the physician to the Professional Inspection Division.
     5. Filing a complaint with the Disciplinary Council.

  6- Will the physician know my identity?

  Generally, yes, the physician must understand the complaint to give their version of the facts. With the consent of the complainant requesting the inquiry, the CMQ sends the complaint letter to the physician to explain his/her actions.

  Complainants who wish to remain anonymous must indicate so. However, the inquiry may be compromised.

  7- What is the physician’s duty following a complaint?

  A physician summoned by the Syndic’s Office because they are the subject of an inquiry, a witness or a source of information, may not plead professional confidentiality and must answer the syndic’s questions or provide documents relevant to the inquiry. The physician cannot contact the complainant during the inquiry.

  8- What kind of discipline is possible if the physician is found guilty by the Disciplinary Council?

  Here is the type of sanctions provided : 

  • Reprimand
  • Temporary or permanent suspension
  • Fine
  • Licence suspension
  • Specialist license suspension
  • Restriction or suspension of professional practice

  9- If I file a complaint, will I be charged any fees?

  No, no fees are charged.
